Terms of Service
The agreement governing your use of PortModels — accounts, credits, published apps, the Connect authorization flow, the API, and app data storage.
These Terms of Service ("Terms") govern your access to and use of PortModels: the website, the app gallery, user accounts, credits, the developer platform, the Connect authorization flow, the API, and app data storage (together, the "Service").
By creating an account, purchasing credits, publishing an app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service#
PortModels is a platform where independent developers publish AI apps and where users run those apps with a single account and a single balance. The Service includes:
- A public gallery of apps published by third-party developers.
- User accounts, with credits that pay for model usage across every app.
- Connect with PortModels, an authorization flow that lets a third-party app act on your behalf without receiving your password.
- An API that routes requests to underlying model providers and meters usage.
- App data storage, consisting of a per-user key-value store and file storage, with optional paid capacity.
- Developer tools for publishing apps, setting pricing, and requesting payouts.
Parts of the Service may be described as planned, beta, or preview. Nothing on the site guarantees feature availability, timing, compatibility, or continued access.
Eligibility and Accounts#
You may use the Service only if you can form a binding contract under applicable law, and only if you are not barred from doing so under the laws of your jurisdiction. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes both you and that organization.
You are responsible for:
- The accuracy of your account information.
- Keeping your password, API keys, and access tokens confidential.
- All activity that occurs under your account, including credit spending, whether or not you authorized it.
Tell us promptly at [email protected] if you believe your account, an API key, or a Connect authorization has been compromised. You can revoke API keys and app authorizations yourself from your account at any time.
Credits and Payment#
Credits are the prepaid unit of account for usage on PortModels. One credit equals one US dollar of purchasing power on the platform. Credits are not currency, not a stored-value instrument, and not redeemable for cash.
- Purchases. Credits are purchased through our payment processor, Stripe. We do not receive or store your full card details. Purchases are subject to a minimum of 1 USD and a maximum of 10,000 USD per transaction.
- Delivery. Credits are added to your balance when the payment processor confirms a completed payment. A payment that fails, is disputed, or is reversed will not result in credits, and may result in a corresponding deduction.
- Spending. Credits are consumed as you use apps and the API. The amount consumed depends on the models used, the size of the request and response, and any markup set by the developer of the app you are running.
- No refunds. Except where refunds are required by applicable law, credit purchases are final and non-refundable, including for unused balances. We may, at our discretion, issue a credit adjustment to correct a billing error on our side.
- Expiry. Credits do not expire while your account is in good standing. Credits associated with an account terminated for a violation of these Terms may be forfeited.
- Taxes. Prices are exclusive of taxes unless stated otherwise. You are responsible for any taxes arising from your use of the Service, other than taxes on our income.
Pricing for models, apps, and storage may change. Changes apply to usage after the change takes effect.
App Data Storage#
Apps you authorize may store data on your behalf in a per-user key-value store and file storage. Storage is subject to plan limits, including a free allowance; additional capacity is available as a monthly subscription billed in euros through Stripe.
- Subscriptions renew monthly until cancelled.
- Cancelling takes effect at the end of the current billing period. Access continues until then, and no partial-period refunds are issued.
- If you exceed your available capacity, further writes may be rejected until you free space or upgrade.
- Recorded usage may lag behind actual usage briefly while uploads are reconciled.
- Data you mark as public may be served to anyone with the link. Do not mark sensitive data public.
We do not guarantee that stored data is preserved indefinitely. Keep your own copies of anything you cannot afford to lose.
Connect with PortModels#
Connect lets a third-party app request scoped access to your PortModels account. When you approve an authorization request:
- The app receives a scoped access token. It does not receive your password.
- The app may perform only the actions covered by the scopes shown to you on the consent screen.
- Model usage the app performs is charged to your credit balance.
You can review and revoke app authorizations at any time from your account. Revoking a token stops future access but does not reverse charges already incurred. Approving an app is your decision, and you are responsible for charges resulting from apps you have authorized.
Developer Terms#
These terms apply in addition to the rest of this agreement if you publish an app.
- Your responsibility. You are responsible for your app: its listing accuracy, its behaviour, its safety, its lawfulness, and its handling of user data. You must have the rights to everything you publish, including images, names, and descriptions.
- Review. Apps are reviewed before appearing in the gallery. We may reject, hide, suspend, or remove any listing at our discretion, including after approval, and including without prior notice where the risk warrants it.
- Licence. You retain ownership of what you publish. You grant PortModels a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your listing content for the purpose of operating and promoting the Service.
- Pricing and earnings. You set a markup on model usage in your app, within the range the platform permits. Earnings accrue from successful metered usage after provider costs.
- Payouts. You may request a payout of your available earnings. Requests are reviewed before they are paid, and we may hold or decline a payout where there is suspected fraud, abuse, chargeback exposure, an unresolved dispute, or a legal obligation. Available earnings are calculated net of prior payouts and pending requests.
- Self-dealing. Generating usage in your own app, or arranging for others to do so, in order to inflate earnings is prohibited and is grounds for forfeiting earnings and terminating your account.
- User data. If your app collects data from users beyond what the platform provides, you must disclose that clearly and comply with applicable data protection law. You may not use PortModels user data for any purpose other than providing your app.
Acceptable Use#
You agree not to misuse the Service. Without limitation, you may not:
- Interfere with the Service's operation, security, or availability, or circumvent rate limits, quotas, metering, or billing.
- Publish apps, comments, prompts, or other content that is false, fraudulent, abusive, malicious, infringing, or unlawful.
- Generate or distribute content that sexually exploits minors, incites violence, facilitates serious harm, or violates the usage policies of the underlying model providers.
- Upload files that are not what they claim to be, or that attempt to exploit the Service's upload or storage handling.
- Attempt to gain unauthorized access to systems, data, other users' accounts, or another developer's app.
- Resell, sublicense, or redistribute API access, credits, or model output in a way that presents the Service as your own infrastructure without publishing an app.
- Use automated means to scrape or overload the Service, except as permitted by law and normal web indexing practices.
- Use PortModels branding, materials, or content in a way that falsely implies endorsement or partnership.
We may suspend access, remove content, or terminate accounts to enforce this section.
Content and AI Output#
You are responsible for the prompts and other input you submit, and for how you use the output you receive.
- Output is generated by machine learning models. It may be inaccurate, incomplete, offensive, or unsuitable for your purpose. Do not rely on it as professional, legal, medical, or financial advice.
- Similar prompts may produce similar output for different users, and we make no claim that output is unique to you.
- As between you and PortModels, and to the extent permitted by law, we do not claim ownership of the output generated from your input. Your rights in that output may be limited by the terms of the underlying model provider and by applicable law.
- We may retain and review input and output where necessary to operate the Service, meter usage, enforce these Terms, and comply with law.
Third-Party Services#
The Service depends on third parties, including model providers, payment processing, and hosting infrastructure. Requests you make may be routed to third-party model providers and are subject to their terms and usage policies. We are not responsible for the availability, accuracy, or practices of third-party services, or for third-party apps published in the gallery.
Intellectual Property#
The Service, its design, branding, text, graphics, and related materials are owned by PortModels or its licensors and are protected by applicable intellectual property laws. Except for the limited use these Terms allow, you may not reproduce, republish, distribute, or create derivative works from Service content without permission.
Suspension and Termination#
You may stop using the Service and close your account at any time. We may suspend or terminate access if we believe you have violated these Terms, created risk or legal exposure for the Service or its users, or acted unlawfully — immediately where the circumstances warrant it.
On termination: your right to use the Service ends, unpaid earnings may be withheld pending review, and unused credits are not refunded except where required by law or where the termination was our error. Sections that by their nature should survive — including payment obligations, disclaimers, limitation of liability, and governing law — survive termination.
No Warranty#
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, PortModels disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements, or that model output will be correct or suitable for any purpose.
Limitation of Liability#
To the maximum extent permitted by law:
- PortModels will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, opportunity, goodwill, revenue, or profits, arising out of or related to the Service.
- Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the three months before the event giving rise to the claim, or (b) 50 USD.
Some jurisdictions do not allow certain limitations, in which case the limitations above apply only to the extent permitted.
Indemnity#
You agree to indemnify and hold harmless PortModels and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the Service, the apps or content you publish, or your violation of these Terms or applicable law.
Changes to the Service and to These Terms#
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms by posting a revised version on this page and updating the last-updated date. Material changes take effect when posted unless a later effective date is stated. Continued use after that point constitutes acceptance.
Governing Law and Disputes#
These Terms are governed by the laws applicable to the operator of PortModels, without regard to conflict-of-law principles, except where mandatory local law requires otherwise. You and PortModels agree to first attempt to resolve any dispute informally by contacting us.
